After Tropical Storm Debby, a couple is battling to repair leaking roof in their condo at Topsail Dunes Villas. Jeff Wells and Jana Passe noticed water leaking into their home and immediately contacted management. Dehumidifiers were installed to prevent mold.
HOA Blames Homeowners for Costs to Repair Leaking Roof
The HOA told the couple that the roof had been patched and inspected, but the leak persisted. Despite being responsible for roof maintenance, the HOA insisted that the couple’s homeowner’s insurance should cover the damages. They also stated that the couple would need to pay for any further roof inspections.
When the HOA filed an insurance claim, it was denied due to a lack of roof maintenance. An appeal was also rejected, and communication between the HOA and the couple fell apart. The HOA then refused to repair the roof unless the couple took legal action.
Wells believes the HOA is trying to force them into a financial bind, as the leak has made their home uninhabitable due to toxic mold. They’ve spent their savings and resorted to selling possessions to cover the costs.
Efforts to contact the HOA and property management for a response have gone unanswered.
