Teywonia Byrd, a resident of Fat City Condos in NoDa, has been living under heightened anxiety since experiencing a traumatic assault. To enhance her personal security, Byrd installed a Ring camera on her door, seeking to monitor her surroundings more closely. However, she discovered that installing the camera required approval from the homeowners association.
Byrd submitted the necessary request to the HOA, but the association denied her application. Despite the rejection, she kept the camera in place. As a result, the HOA began fining her $100 per day, leading to an accumulation of fines over several years.
The HOA’s legal team argued that the issue was not about the modification of the exterior door but about privacy concerns. They expressed apprehension about residents recording their neighbors. They asserted that Byrd could have installed multiple cameras inside her unit without violating privacy rules.
Legal Action and Loss
Byrd took legal action against the HOA and went to trial. Ultimately, though, the jury ruled against her. As a result, she now faces a $73,000 payment. Additionally, the HOA’s attorneys are seeking to recover their legal fees, amounting to $65,000 for one part of the case and $50,000 for another.
Throughout this ordeal, Byrd maintained that her decision to keep the camera was due to a need for security, not financial considerations. Both sides confirmed that the HOA had offered to settle the case and waive the fees if Byrd removed the camera. However, she declined the offer, prioritizing her security over the settlement.
Despite the financial burden and ongoing legal battle, Byrd remains resolute in her decision. She is determined to ensure her safety in her home.
