Can you keep pet chickens in HOA communities? After a lengthy battle with their homeowners association, the answer is a solid yes for one family.
Keeping Pet Chickens in HOA
A Union County family recently celebrated a significant victory after facing fines for housing chickens as household pets.
Initially situated in a Waxhaw neighborhood, the family encountered neighborhood regulations prohibiting poultry ownership. However, the rules allowed for household pets, provided that they weren’t a source of income.
The family passionately argued that their feathered friends were indeed pets, sharing anecdotes of bathing and blow-drying them inside their home. They emphasized that they had no intention of using the chickens for consumption or egg sales.
Despite getting a fine of over $31,000 from the homeowners association, the state court of appeals intervened, categorizing the chickens as pets rather than poultry. Consequently, the family was relieved of the financial burden.
