On December 18, 2024, the management company of the Hedingham Homeowners Association filed a motion to dismiss a Raleigh mass shooting lawsuit. Survivors and victims’ families had previously filed the lawsuit, claiming the HOA failed to act despite knowing the shooter was a threat.
Raleigh Mass Shooting Lawsuit Focuses on HOA’s Legal Responsibility
The HOA management company, H.R.W., denies any liability in the October 2022 shooting that left five dead and two injured. They argue the shooting occurred in privately owned homes, and the addresses were not listed in the original lawsuit. The company asserts that the HOA had no legal duty to the victims.
The HOA’s guidelines state that all homeowners are members of the association. However, it also specifies that the HOA is not responsible for enforcing rules like gun prohibitions in the neighborhood.
